By accessing or using bartelevision.com (the "site"), you agree to these Terms of Use. If you do not agree, do not use the site. The site is offered free of charge and is provided on an "as is" basis.
Acceptable use
You may use the site for personal, professional, or commercial purposes within your own venue or workspace, including running the screen tests on displays you own or are responsible for. You agree not to:
- Attempt to disrupt the site, bypass security controls, or access non-public areas.
- Scrape the site at a rate or volume that interferes with normal service to other users.
- Republish substantial portions of the site's text or directory as your own.
- Use the site in any way that violates applicable law or the rights of others.
- Misrepresent that the site, its operators, or any directory entry endorses your business.
Use of the screen-testing tools
The dead pixel test displays solid colors and is generally low risk. The burn-in fixer uses rapid, high-contrast color flashing that may trigger seizures in people with photosensitive epilepsy. A confirmation prompt is shown before that tool runs. By proceeding past the prompt, you accept the risk for yourself and for anyone in viewing range. See the disclaimer for the safety notice in full.
Intellectual property
All site text, layout, code, and original graphics are owned by Bart Television unless otherwise noted, and are protected by copyright and other intellectual-property rights. You may view and print pages for personal reference. Reuse beyond that requires permission. Short, attributed quotations for commentary, news, or research are permitted under standard fair-use principles.
The ambient video directory links to third-party videos hosted on YouTube. Those videos belong to their respective creators and are subject to YouTube's terms and the creators' chosen licenses. Bart Television claims no rights in linked videos and does not redistribute them.
"Bart Television" and the site's logo are used as identifiers for this project. They are not affiliated with, endorsed by, or sponsored by any television manufacturer, broadcaster, or trademark holder of a similar name.
Third-party content and links
The site links to external pages, including YouTube and the privacy controls of advertising vendors. Those external pages are governed by their own terms and policies. Bart Television does not control them and is not responsible for their content, availability, or behavior.
Advertising
Display advertising is served through Google AdSense and may be personalized in line with Google's policies. The presence of an ad does not imply an endorsement by Bart Television of the advertised product or service. See the privacy policy for details on how ad data is handled.
Disclaimer of warranties
The site and its tools are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Bart Television does not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any information on the site is complete, accurate, or current.
Limitation of liability
To the fullest extent permitted by law, Bart Television, its operators, and contributors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to use of the site or its tools, including damages to displays, lost data, lost profits, or personal injury. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify and hold Bart Television harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the site, your violation of these terms, or your violation of any law or third-party right.
Governing law
These terms are governed by the laws of [Jurisdiction], without regard to conflict-of-laws principles. Disputes that cannot be resolved informally will be heard in the courts of that jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.
Changes to these terms
These terms may be updated from time to time. The "Last reviewed" date below shows the most recent revision. Continued use of the site after a change constitutes acceptance of the updated terms. Material changes will be highlighted on this page.
